L. M. Hawkes and NSH Publishing, LLC respect your privacy and are committed to protecting the personal information you choose to share with us.

This Privacy Policy explains what information we collect, how we use it, how uploaded photographs are handled, how customer images are stored and processed, and what choices you have regarding your information.

This policy applies to Hawkes Adventures, including products and services offered through hawkesadventures.com, including but not limited to Art Pack Configurator, Spot the Anachronism, Three Lives, and related products.


Information We Collect

We may collect information that you voluntarily provide to us, including:

  • your name;
  • your email address;
  • billing and order information;
  • account information, if you create an account;
  • uploaded photographs or files submitted for custom products;
  • customer support messages;
  • consent choices, such as gallery or marketing permissions;
  • product preferences, download choices, and retention choices.

Payment information may be processed by third-party payment processors. We do not intentionally store full credit-card numbers on our own servers.


How We Use Your Information

We use your information to:

  • process orders;
  • deliver purchased products;
  • create custom images or other custom materials;
  • provide download access;
  • respond to customer support requests;
  • manage accounts;
  • send order-related communications;
  • send optional marketing or update emails if you have opted in;
  • improve site functionality, security, and customer experience;
  • comply with legal, payment, tax, fraud-prevention, and security obligations.

We do not sell, rent, or trade your personal information.


Photo Privacy and Child Safety

Some Hawkes Adventures products, including Three Lives, may allow a parent, guardian, or adult customer to upload a photograph so that we can create custom historical portrait images.

Because these uploads may include photographs of minors, we treat uploaded photos as sensitive customer materials.

Uploaded photographs are used only to create the customer’s ordered images, support order delivery, and handle related customer-service or technical-support needs.

We do not sell uploaded photographs.
We do not rent uploaded photographs.
We do not share uploaded photographs with advertisers.
We do not use uploaded photographs for unrelated marketing.


Photos of Minors

If a photograph includes a minor, the person placing the order must be the child’s parent or legal guardian, or must have permission from the child’s parent or legal guardian.

By uploading a child’s photograph, the customer confirms that they have the authority to submit that image for the ordered service.

We do not knowingly accept photo uploads from children acting on their own.


How Uploaded Photos Are Stored

Uploaded source photographs are stored on private Amazon Web Services infrastructure protected by password and multi-factor authentication controls.

Uploaded source photographs are not stored on servers intended to be publicly accessible.

We fully understand the importance of keeping private customer data safe, and photographs of minors are treated as especially sensitive.

No method of electronic storage or transmission can be guaranteed to be completely secure, but we take reasonable measures to protect uploaded photos, generated images, download files, and related customer materials.


How Uploaded Photos Are Processed

To create custom portrait images, Hawkes Adventures may transmit the uploaded source photograph to one or more image-processing providers.

At present, this processing may include fal.ai and, depending on the model route used for the order, OpenAI or other model providers made available through that processing infrastructure.

These providers are used only to generate the ordered images and to support the technical operation, safety, security, and abuse-prevention requirements of the service.

Hawkes Adventures does not authorize these providers to use customer-uploaded photographs for advertising, public display, unrelated marketing, or resale.

Hawkes Adventures does not use uploaded customer photographs to train AI models.

OpenAI states that API and business customer data is not used to train OpenAI models by default unless the customer explicitly opts in. Provider-side handling may also be governed by fal.ai’s policies, OpenAI’s policies where OpenAI models are used, applicable law, and agreements between infrastructure providers and model providers.

Some provider-side retention, moderation, or safety-review handling may be controlled by the provider’s own policies or by agreements between infrastructure providers and model providers, rather than directly by Hawkes Adventures.


Safety and Abuse Monitoring

Image-processing providers may use automated systems to detect prohibited, abusive, or unsafe content.

Provider policies may allow temporary retention of submitted material, generated material, request data, or related logs for safety, abuse monitoring, legal, fraud-prevention, or security purposes.

For OpenAI API processing, OpenAI documents abuse-monitoring logs and default retention practices for certain API data. fal.ai also publishes documentation and policies related to data retention, uploaded media, generated media, safety, and acceptable use.

In rare cases, if submitted material is flagged by automated safety systems, it may be reviewed by a human reviewer for abuse-monitoring or safety-enforcement purposes.

Hawkes Adventures’ Three Lives workflow is designed to submit only the image material needed to create the ordered portraits.


Photo Retention and Deletion

By default, uploaded source photographs are scheduled for deletion 30 days after order completion.

Customers may choose a different retention period through their private download page, including longer retention for possible reorders.

When uploaded source photographs reach the applicable deletion date, they are deleted by an automated process.

or, where available, through their customer account.

Deletion requests will be handled within a reasonable period unless retention is required for legal, payment, fraud-prevention, security, tax, chargeback, dispute-resolution, or compliance reasons.


Generated Images

Generated images may be retained longer than the original uploaded source photograph.

This may happen when generated images are needed for:

  • customer download access;
  • reorders;
  • customer support;
  • order records;
  • product delivery;
  • gallery use, if the customer has separately granted permission;
  • marketing use, if the customer has separately granted permission.

The original uploaded source photograph and the generated portrait images are treated as separate file types for retention purposes.

Deleting an uploaded source photograph does not necessarily require immediate deletion of generated images unless the customer also requests deletion of the generated images, or unless applicable law requires deletion.


Download Access and Security

Customer images are delivered through a password-protected download page or other private order-access system.

Download links do not normally expire after 72 hours. Access is normally controlled through the customer’s private download page.

Customers should not share private download-page links, passwords, or account credentials with anyone they do not want to access the images.


We will not use a customer’s uploaded source photograph, child’s image, generated portrait, testimonial, before/after example, order example, or custom image in public marketing, galleries, social media, advertising, product pages, or promotional materials unless the customer gives separate, explicit permission.

Buying a product does not automatically grant Hawkes Adventures permission to display the customer’s images publicly.

Optional gallery or marketing permission may be offered separately. If permission is given, the customer may request removal later by contacting us.


Customer Choices

Customers may:

  • request deletion of uploaded source photographs;
  • request deletion of generated images;
  • choose a longer or shorter source-photo retention period where available;
  • decline gallery or marketing use;
  • request removal of previously approved gallery or marketing examples;
  • unsubscribe from marketing emails;
  • contact us with privacy questions.

We may need order-identifying information to locate the relevant files.


Email Communications

If you place an order, create an account, join a mailing list, request updates, or otherwise provide your email address, you may receive emails related to:

  • your order;
  • downloads;
  • account access;
  • customer support;
  • product updates;
  • optional newsletters or announcements, if you subscribed.

You may unsubscribe from marketing emails by using the unsubscribe link included in those emails or by contacting us directly.

Order, account, legal, security, and transaction-related emails may still be sent when necessary.


Information Sharing

We do not sell, rent, or trade your personal information.

We may share information only as needed with service providers who help us operate the site, process orders, deliver products, provide infrastructure, process payments, provide customer support, generate custom images, monitor security, or comply with legal obligations.

These providers may include, depending on the service used:

  • website hosting providers;
  • cloud infrastructure providers;
  • payment processors;
  • email service providers;
  • image-processing providers;
  • security, fraud-prevention, or abuse-monitoring providers;
  • analytics or service-monitoring providers;
  • legal, tax, accounting, or compliance providers.

We may also disclose information if required by law, legal process, payment dispute, fraud investigation, security issue, or to protect the rights, safety, property, or integrity of this site, its customers, its operators, or others.


Third-Party Provider Policies

Some services used by Hawkes Adventures are operated by third-party providers.

For image-processing services, relevant provider policies may include:

  • fal.ai Trust & Safety Policy;
  • fal.ai Acceptable Use Policy;
  • fal.ai API Services Terms;
  • fal.ai data-retention and media-expiration documentation;
  • OpenAI API data controls and data-usage policies;
  • OpenAI business data privacy, security, and compliance information;
  • OpenAI Privacy Policy and usage/safety policies.

Provider policies may change over time. Where provider handling applies, their current policies and contractual obligations may affect how submitted material, generated material, request data, safety logs, and abuse-monitoring records are handled.


Data Storage and Security

We take reasonable measures to protect the information you provide.

These measures may include private cloud storage, password controls, multi-factor authentication, restricted access, account-based access, private download pages, and automated deletion processes.

However, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security.

Customers are responsible for keeping their own account credentials, download-page passwords, and private links secure.


This site may contain links to external websites, including provider policies, payment processors, social platforms, affiliate sites, or other resources.

We are not responsible for the privacy practices, security practices, or content of external websites.


Children’s Privacy

Our products are intended to be purchased by adults.

We do not knowingly collect personal information directly from children acting on their own.

For products involving photographs of minors, the upload must be made by a parent, legal guardian, or adult who has permission from the child’s parent or legal guardian.
