As an authorized affiliate (“Affiliate”) of NSH Publishing, LLC / Hawkes Adventures (“we”, “us”, “our”), you agree to abide by the terms and conditions contained in this Agreement (the “Agreement”). Your participation in the Hawkes Adventures Affiliate Program (the “Program”) is solely to lawfully advertise our website and products in order to earn a commission on qualifying products purchased by customers you refer to us.

By signing up for the Program, you indicate your acceptance of this Agreement and its terms and conditions.

Approval or Rejection of the Application

We reserve the right to approve or reject ANY Affiliate Program application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your application. We also reserve the right to approve or reject any particular referral or sale that does not comply with this Agreement.

Commissions

Commission is earned on qualifying product purchases made by customers you refer to us. The commission rate on eligible products is twenty-five percent (25%) of the product subtotal. The product subtotal excludes shipping and taxes; commission is calculated on the price of eligible products only.

Not all products carry the 25% rate. Eligible products are those we designate as commissionable at that rate; other products may carry a different rate or no commission. The current commissionable product lines and any changes to eligible products or rates will be communicated to Affiliates.

You cannot refer yourself, and you will not earn a commission on your own purchases or accounts. Commissions are earned only on transactions that complete successfully. Transactions that are later refunded, reversed, or result in a chargeback will not be paid, and any commission already recorded for such a transaction will be reversed.

Lifetime Attribution

When you refer a customer through your affiliate link, that customer becomes attached to your affiliate account. Attribution is tracked server-side and is tied to the customer’s email address, so it persists for the life of that customer relationship and is not limited to a single browser or device. The referral cookie placed on first click has a 30-day window, but attribution is confirmed and made permanent once the referred customer completes a qualifying purchase.

The first Affiliate to whom a customer becomes attached keeps that customer. Once a customer is attached to your account, that attachment is not transferred to a later Affiliate.

Attribution applies across our eligible product lines. If a customer you referred returns and buys other eligible Hawkes products later – including new products and new seasonal offerings we add over time – those qualifying purchases continue to earn you commission for as long as the customer remains attached to your account and this Agreement remains in effect.

Payment

Commissions are paid through Stripe or PayPal, whichever you choose in your Affiliate Area. To be paid by Stripe, you must complete Stripe payout onboarding; to be paid by PayPal, you must give us the PayPal email address to pay. Either way, you must provide the tax documentation described below.

Each earned commission is subject to a holding period of fourteen (14) days from the date of the qualifying sale before it becomes eligible for payout. This holding period allows for refunds, reversals, and chargebacks. A commission tied to a transaction that is refunded, reversed, or charged back during or after the holding period will not be paid, or will be reversed if already recorded.

Commissions are paid per commission, automatically, after the 14-day holding period clears. There is no minimum payout threshold.

Taxes

Before any commission is paid, you must provide accurate and complete tax documentation appropriate to your status: a Form W-9 if you are a U.S. person, or the applicable Form W-8 (for example, Form W-8BEN) if you are not a U.S. person. You are responsible for any taxes owed on commissions you earn. We may withhold or report payments as required by applicable law.

Termination

Your Affiliate account and this Agreement may be terminated if you engage in any of the following:

  • Inappropriate, false, or misleading advertisements, claims, or representations, including any false or misleading statement about Hawkes Adventures products or how they are produced.
  • Spamming or unsolicited commercial messaging of any kind.
  • Advertising on sites containing or promoting illegal activities.
  • Failure to clearly disclose your affiliate relationship in accordance with FTC guidelines and applicable law.
  • Violation of our intellectual property rights or the license agreements governing use of our trademarks, images, and other materials.
  • Offering rebates, coupons, kick-backs, or other incentives funded out of your commission as an inducement to purchase (ordinary bundling or bonuses you provide are acceptable).
  • Self-referrals, fraudulent transactions, or manipulation of tracking or attribution.

We reserve the right to terminate any Affiliate account at any time, for any violation of this Agreement or for no reason.

Commissions that are already earned and valid at the time of termination will still be paid, even where we terminate without cause. Commissions tied to fraud or to a violation of this Agreement are forfeited.

You may use graphic and text links on your website and in other media, including within emails you are permitted to send, and in online or offline classified advertisements, magazines, and newspapers. You may use the graphics and text we provide, or your own, provided they are accurate and otherwise comply with this Agreement, including the Termination section. Affiliates may use a custom slug in their referral links (for example, /ref/yourname).

You must accurately represent Hawkes Adventures products. Product availability differs by product: some products are live and some are planned or seasonal. Do not represent a planned or unavailable product as currently available.

Coupon and Deal Sites

You may promote Hawkes Adventures on coupon and deal sites. You may promote a coupon code only if we have assigned it to you. The following terms apply to any affiliate considering the promotion of our products in relation to a deal or coupon:

  • You may not use misleading text on affiliate links, buttons, or images to imply anything other than the deals currently authorized to you specifically.
  • You may not bid on “Hawkes Adventures Coupons,” “Hawkes Adventures Discounts,” or other phrases implying coupons are available.
  • You may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button, or image for that particular coupon or deal. Your link must send the visitor to our site.
  • The user must be able to see the coupon, deal, or savings information and details before an affiliate cookie is set (i.e., a “click here to see coupons” link that opens a window and sets a cookie is NOT allowed).
  • Your sites may not display “Click for (or to see) Deal/Coupon” or any variation when no coupons or deals are available and the click opens our site or sets a cookie. Affiliates with such text will be removed from the Program immediately.

You may run paid advertising to promote Hawkes Adventures products on any platform where we are not running our own advertising. We currently run our own advertising on Meta (Facebook and Instagram), so you may not run paid advertising there. We will tell Affiliates when this list changes, and you must stop paid advertising on a newly listed platform as soon as we notify you. All paid advertising must meet the rest of this Agreement, including accurate claims and clear disclosure of your affiliate relationship.

In particular, and whether or not other paid advertising is permitted, you may not bid on our brand terms, trademarks, or misspellings of them, and you may not direct-link advertisements to our site, without our prior written permission.

Liability

We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising out of your participation in the Program, including as a result of tracking failures, database loss, or downtime. We make no express or implied warranties with respect to the Program, and we do not warrant that the Program or the site will operate error-free or without interruption.

Term of the Agreement

The term of this Agreement begins upon your acceptance and continues until terminated by either party. We may modify any of the terms and conditions of this Agreement at any time and at our sole discretion. If any modification is unacceptable to you, your only option is to terminate your participation in the Program. Your continued participation following a modification constitutes your acceptance of the modified terms.

Indemnification

You agree to indemnify and hold harmless NSH Publishing, LLC / Hawkes Adventures and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by us to transmit and distribute materials, from and against any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to your participation in the Program, including any negligence, misrepresentation, failure to disclose your affiliate relationship, or intentional misconduct on your part.

Governing Law

This Agreement is governed by the laws of the State of South Carolina, without regard to its conflict-of-laws provisions.

Electronic Signatures Effective

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Hawkes Adventures affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the NSH Publishing / Hawkes Adventures application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
